The Requirement to Have a Lawyer Present During Real Estate Sales Under the 12th Judicial Package
As part of the 12th Judicial Package prepared by the Ministry of Justice, there are plans to introduce a requirement for representation by an attorney in title deed transactions exceeding a certain amount.
Under the current system in Turkey, there is no requirement to have a lawyer present for individual real estate transactions. Citizens submit their applications through the Webtapu system and may participate in the signing process in person or through a power of attorney.
It has been announced that, under the 12th Judicial Package, the requirement for legal representation by an attorney will be introduced for real estate transactions exceeding a certain amount. According to the Ministry's statement, the regulation will apply only to real estate purchase and sale transactions of 30 million TL or more. The primary aim in setting this threshold is to avoid imposing an additional financial burden on citizens for low- and medium-value transactions.
Regarding attorney fees for land registry transactions, no clear details have been established yet.
